It’s not over between Chris Daughtry and his ex-band members.

According to MSNBC, Daughtry is being sued by his former bandmates from Absent Element–the band he had before making it big with “American Idol”.

Bassist Ryan Andrews, drummer Scott Crawford and guitarist Mark Perry filed a lawsuit last Thursday in Guilford County Superior County claiming that the season five finalist defrauded them out of royalties from four songs, including music and lyrics, that the group had written together. The lawsuit cites “constructive fraud, breaches of fiduciary duty, unfair trade practices and other deceptive and wrongful conduct” on the part of Daughtry.

Daughtry posted a brief statement on his official band website on the matter, saying,

“I am very hurt by these false accusations. The songs listed in this lawsuit were written solely by me and no one else and at this time, I have no further comment.”

Daughtry finished in fourth place during “Idol’s” fifth season, the same season that featured Katharine McPhee, the star of NBC’s “Smash”.
